Customer Newsletter No 19 March 2011

Spring has arrived in Edinburgh and the crocuses are flowering in the Meadows. Although perhaps they should be more cautious - there's still a snell wind and frost at night. Snow is still a possibility, we've seen it in June here!

Rather a slow publishing start to the year but there are a few titles to draw to your attention. Bloomsbury Professional have brought out a guide to practice and procedure under the new-ish Tribunals regime: The New Tribunals Handbook is priced at £75. Jordans will shortly be publishing a competitor title: Tribunal Practice is due to be available at the end of March, priced at £125.

At about the same time Jordans will publish The Bribery Act 2010: A Practical Guide. This UK-wide Act has implications for companies in particular and the book provides practical guidance on setting up compliance procedures.

Amongst the Scottish books available now is Law Making and the Scottish Parliament: The Early Years. Edited by Elaine Sutherland and published by EUP this is the first critical analysis of the legislation produced by the Scottish Parliament since devolution.

Criminal Evidence and Procedure: An Introduction (3rd edn)
AN Brown
Publisher: Avizandum Publishing
Published: Dec 10
ISBN: 9781904968320
£48.00 Pbk

A practical and accessible introduction to the conduct of criminal cases. The text is structured according to the various stages of a criminal prosecution, from initial investigation through trial to sentencing and appeal.

It approaches the subject in an integrated way, recognising that there is a substantial degree of interpenetration between evidence and procedure. Procedure is considered in the general order in which steps occur in prosecutions, with solemn and summary procedure dealt with together as far as possible, and matters of evidence covered as they become relevant.

The Criminal Procedure (Scotland) Act 1995 provides the framework of the text. This revised edition covers recent developments in case law and legislation, including the provisions of the Criminal Justice and Sentencing Act 2010. Criminal Evidence and Procedure is a succinct, but comprehensive, guide to the essentials of the subject for those approaching it for the first time, while also providing practitioners with a useful vade mecum.

The Coalition and the Constitution
V Bogdanor
Publisher: Hart Publishing
Expected Publication Date: 30/03/11
ISBN: 9781849461580
£20.00 Pbk

'England', Benjamin Disraeli famously said, `does not love coalitions'. But 2010 saw the first peace-time coalition in Britain since the 1930s. The coalition, moreover, may well not be an aberration. For there are signs that, with the rise in strength of third parties, hung parliaments are more likely to recur than in the past. Perhaps, therefore, the era of single-party majority government, to which we have become accustomed since 1945, is coming to an end. But is the British constitution equipped to deal with coalition? Are alterations in the procedures of parliament or government needed to cope with it?

The inter-party agreement between the coalition partners proposes a wide ranging series of constitutional reforms, the most important of which are fixed-term parliaments and a referendum on the alternative vote electoral system, to be held in May 2011. The coalition is also proposing measures to reduce the size of the House of Commons, to directly elect the House of Lords and to strengthen localism. These reforms, if implemented, could permanently alter the way we are governed.

This book analyses the significance of coalition government for Britain and of the momentous constitutional reforms which the coalition is proposing. In doing so it seeks to penetrate the cloud of polemic and partisanship to provide an objective analysis for the informed citizen.

International Pre-Nuptial and Post-Nuptial Agreements
D Salter
Publisher: Jordan Publishing
Expected Publication Date: 30/03/11
ISBN: 9781846612312
£95.00 Pbk

In an ever more international world, the issue of divorce often implies a foreign element, resulting from the different nationalities of the spouses , the location of their estates or their country of residence. European Regulation EC 2201/2003 provides for a choice of jurisdictions in divorce matters and this has encouraged the phenomenon of divorce shopping.

Most national laws provide for a contractual system whereby spouses can organise, to some extent , the financial consequences of marriage breakdown. Often these contractual agreements will be drafted pursuant to the law of the country where the marriage is to be celebrated or/and where the spouses reside. The difficulty in the case of divorce is that such contracts may not be recognised or enforced by another country which may have jurisdiction over the breakdown of the marriage of the parties.

It has therefore become increasingly important to understand the specific requirements of these countries in relation to the recognition and enforcement of the contractual documents involved, in order to ensure their validity in the eventuality of a divorce taking place in one of these countries.

With contributions from a number of fellows of the International Academy of Matrimonial Lawyers (IAML) in jurisdictions such as France, Australia, England, Canada, Switzerland and the United States, this work looks at how each individual jurisdiction approaches pre-nuptial agreements and also considers the thornier issue of agree ments which cover couples involved in more than one jurisdiction.
