Happy New Year!

The long-awaited third edition of Lord Macphail’s Sheriff Court Practice was published at the end of November and is now in stock at Avizandum. Edited by Sheriff T Welsh, QC and a team of distinguished sheriffs, this is an essential text for all those who practise in the sheriff court in Scotland.

The new year will also bring a wave of books from law publishers offering full text of & commentary on the Companies Act 2006. These include titles from Lexis Nexis, Jordans, Blackstone’s Guides & the Institute of Chartered Secretaries and Administrators. Full details are in the Forthcoming Titles section below.

Our sister company, Avizandum Publishing, published Public Law in Scotland in November 2006. This important new title, edited by two distinguished Scottish academics, Aileen McHarg & Tom Mullen, examines the differences between the public law of Scotland & that of the rest of the UK since the creation of the new Scottish Parliament. Since the Union between Scotland & England in 1707, public law has often been regarded as largely identical north & south of the border. However there have always been differences between Scotland & the other jurisdictions in the UK, both in terms of government institutions & legal doctrines. Devolution has added to this distinctiveness & given rise to a range of new public law issues which are examined in this collection of essays by leading Scottish academics.

At Avizandum Law Bookshop we keep a comprehensive stock of new Scots law books as well as a wide range of law books from other jurisdictions.

The shop is situated in Candlemaker Row (off George IV Bridge) and is close to the Courts & Edinburgh University’s Law Faculty.

If the title you are looking for is not in stock we can order it for you. We also offer an efficient book-finding service for rare titles or foreign law books.

We hope this newsletter will be helpful and we welcome your suggestions

Expected Publication Date: 31/03/07
£135.00 Hbk
This new practitioner-orientated text provides a clear & comprehensive account of the legal principles & doctrines which come into play whenever the parties disagree about the meaning & effect of the contractual words. Although the common law principles & techniques of construction are of long ancestry, they have recently come to greater prominence as judges have self-consciously sought to modernise the approach to the interpretation of contractual instruments. This work provides a new & refreshed account of the principles involved, focusing on the practitioner's needs, tackling modernisation head on & equipping readers with the necessary means to avoid pitfalls in contractual provisions. The coverage extends to related rules & doctrines, including rectification & implication of terms, & consideration of the status of the controversial 'parol evidence rule.' The book also considers the nature & effect of particular species of contractual provision, including warranties & indemnities, exemption clauses, 'force majeure' clauses & 'entire agreement' clauses.
