Customer Newsletter No 8 September 2008

Wtih the start of the new academic and court year Greens have published new editions of the Court of Session and sheriff court rules and the Solicitors' Professional Handbook. A new edition of Fiona Raitt's book on Evidence has also come out, under a new title Evidence: Principles, Policy and Practice. Also for Greens, Nicholas Grier has annotated the Bankruptcy and Diligence etc (Scotland) Act 2007which should prove an invaluable guide to the comprehensive reforms to the law of sequestration and personal insolvency.

Amongst the forthcoming titles, one of the most useful for professional conveyancers will be Conveyancing in the Electronic Age by Professors Rennie and Brymer. Due to be published at the end of September, this book aims to guide solicitors through the new electronic systems and the legislation.

Finally, for some light reading, we recommend a new perspective on a significant event in Scottish history, written by one of Scotland's most eminent judges, Lord Rodger of Earlsferry. The Courts, The Church and the Constitution: Aspects of the Disruption of 1843 examines the cases triggered by the establishment of the Free Church in the Court of Session and House of Lords and the constitutional and legal implications of the Disruption. In Lord Rodger's words 'the highly intelligent judges, lawyers and ministers of the day devoted their very best efforts to a subject which was of vital importance to the life of Scotland....Whether they would have admitted it or not, they were all having the time of their lives.'

At Avizandum Law Bookshop we keep a comprehensive stock of new Scots law books as well as a wide range of law books from other jurisdictions.

The Courts, The Church and the Constitution: Aspects of the Disruption of 1843
Lord Rodger of Earlsferry
Publisher: Edinburgh University Press
Published: July 08
ISBN: 9780748637546
£30.00 Pbk
Commissioned by the Clark Foundation for Legal Education, this book is derived from the inaugural Jean Clark Lectures, hosted by the University of Aberdeen in 2007.

Across three lectures, Lord Rodger of Earlsferry discusses and analyses the legal and constitutional issues arising from the Disruption of the Church of Scotland in 1843, when the majority of leading ministers left the Church of Scotland to set up the Free Church. He takes a fresh look at the series of cases in the Court of Session and the House of Lords between 1837 and 1843 which led to the Disruption, showing how they gave rise to the most important constitutional crisis and challenge to the Courts' authority that had occurred since the 1707 Union.

ISBN: 9780521889971

It also contains the results of a comparative project covering 14 jurisdictions in 13 European countries (Austria, Belgium, England and Wales, Finland, France, Germany, Greece, Ireland, Italy, Netherlands, Portugal, Scotland, Spain, Sweden) on the private law aspects of environmental liability. It addresses the main problems of the application of tort law in environmental law, such as the availability of non-fault liability, the establishment of causation, the scope of available remedies and the issue of legal standing. How Judges Think
R A Posner
Publisher: Harvard University Press
Published: Sep 08
ISBN: 9780674028203
£19.95 Hbk
A distinguished and experienced appellate court judge, Richard A Posner offers in this new book a unique and, to orthodox legal thinkers, a startling perspective on how judges and justices decide cases. When conventional legal materials enable judges to ascertain the true facts of a case and apply clear pre-existing legal rules to them, Posner argues, they do so straightforwardly; that is the domain of legalist reasoning. However, in non-routine cases, the conventional materials run out and judges are on their own, navigating uncharted seas with equipment consisting of experience, emotions, and often unconscious beliefs. In doing so, they take on a legislative role, though one that is confined by internal and external constraints, such as professional ethics, opinions of respected colleagues, and limitations imposed by other branches of government on freewheeling judicial discretion. Occasional legislators, judges are motivated by political considerations in a broad and sometimes a narrow sense of that term. In that open area, most American judges are legal pragmatists. Legal pragmatism is forward-looking and policy-based. It focuses on the consequences of a decision in both the short and the long term, rather than on its antecedent logic. Legal pragmatism so understood is really just a form of ordinary practical reasoning, rather than some special kind of legal reasoning.

Music Publishing: The Road to Royalties
R Sobel & D Weissmann
Publisher: Routledge Cavendish
Published: Jun 08
ISBN: 9780415976213
£16.99 Pbk
Music Publishing covers the basics of how a composition is copyrighted, published, and promoted. When we think of publishing, we often think of the printed, physical form - sheet music - that a composition may take. However, publishing in the music business goes far beyond the physical sheet - it includes live performance and mechanical (recording) rights, and income streams from licensing deals of various kinds. A single song can generate over 30 different royalty streams, and a writer must know how these royalties are calculated and who controls the flow of the money.

Taking a practical approach, the authors - one a successful music publisher and attorney, the other a songwriter and music business professor - explain in simple terms the basic concept of copyright law as it pertains to compositions. They examine the sources of income, the typical music publishing agreements, and explore some 'myths' about music publishing, offering advice as to when to sign with a publisher. Throughout, they give practical examples from 'real world' situations that illuminate both potential pitfalls and possible upsides for the working composer.

Forging the State: European State Formation and theAnglo-Scottish Union of 1707
A McKillop & M O'siochru
Publisher: Dundee University Press
Expected Publication Date: 30/09/08
ISBN: 9781845860486
£40.00 Pbk
This book highlights the continental background to the formation of the United Kingdom. The 1707 Union was only one example of a more generalised process of European state formation and national realignment during the seventeenth and eighteenth centuries. The book provides a number of case studies of other contemporaneous attempts at union, ranging from Poland-Lithuania, Aragon and Castile, Ireland and Austria-Hungary. When negotiating its amalgamation with England, Scotland could draw upon a wide variety of constitutional, political and economic variants of union. While Scots received much of their legal, intellectual and political traditions from northern Protestant Europe, this book argues that southern, central and Catholic Europe also provided influential examples of state formation and union.
The final two chapters highlight the medieval origins of the debate on Scottish union with England, as well as the profound impact of the 1707 treaty at the local level.

The End of Lawyers? Rethinking the Nature of Legal Services
R Susskind
Publisher: Oxford University Press
Expected Publication Date: 30/11/08
ISBN: 9780199541720
£24.99 Hbk
In this much anticipated sequel to the legal bestseller, The Future of Law, Susskind lays down a challenge to all lawyers to ask themselves, with their hands on their hearts, what elements of their current workload could be undertaken differently - more quickly, cheaply, efficiently, or to a higher quality - using alternative methods of working. The challenge for legal readers is to identify their distinctive skills and talents, the capabilities that they possess that cannot, crudely, be replaced by advanced systems or by less costly workers supported by technology or standard processes, or by lay people armed with online self-help tools.

It is argued that the market is increasingly unlikely to tolerate expensive lawyers for tasks (guiding, advising, drafting, researching, problem-solving, and more) that can equally or better be discharged, directly or indirectly, by smart systems and processes. It follows, the book claims, that the jobs of many traditional lawyers will be substantially eroded and often eliminated. This is where the legal profession will be taken, it is argued, by two forces: by a market pull towards commoditisation and by pervasive development and uptake of information technology. At the same time, the book foresees new law jobs emerging which may be highly rewarding, even if very different from those of today.

William Blackstone: Law and Letters in the Eighteenth Century
W Prest
Publisher: Oxford University Press
Expected Publication Date: 31/10/08
ISBN: 9780199550296
£29.99 Pbk
Lawyer, judge, politician, poet, teacher, and architect, William Blackstone was a major figure in eighteenth century public life. Over his varied and brilliant career he made profound contributions to English politics, law, education, and culture through involvements in legal practice, Parliament, and the University of Oxford. Throughout he also remained engaged in his society's literary and spiritual life. Despite the breadth and influence of his work, Blackstone the man remains little known and poorly understood, the lack of engagement with his public and private life standing in stark contrast to the scale of his influence, particularly on the development and teaching of the law.

Blackstone's 'Commentaries on the Laws of England' remains the most celebrated and influential text in the Anglo-American common-law tradition. This great book has inevitably overshadowed its author, while the dispersal of his personal and professional papers further complicates the task of understanding the man behind the work. The lack of a thorough account of Blackstone's life has fuelled controversy surrounding his intellectual background and political views. Was he the deeply reactionary conservative painted by Bentham, or rather a committed reformer and early champion of human rights?

The present biography makes full use of a considerable body of new evidence that has emerged in recent years to shed light on the life, work, and times of this neglected figure in English and American history. Exploring Blackstone's family upbringing and private life, his political activities and ideology, his religious outlook, and championing of the enlightenment, this book weaves together the threads of an extraordinary mind and career.
